Most governments around the world want to protect their own workforce, while allowing local companies to employ foreign workers. South Africa is no exception and that is why the Department of Home Affairs makes the general work visa for South Africa available.
This visa is open to foreigners who do not qualify for a critical skills visa or who are looking to work for companies not in possession of a corporate work visa.
Employer responsibilities in the case of a general work visa for South Africa
The most important responsibility, or requirement, when it comes to a general work visa for South Africa, is showing that a South African permanent resident or citizen could not be found to fill a position. The proof for this would be an advertisement placed in South African media to attract applicants.
Secondly, a South African employer must issue a prospective foreign employee with a valid offer of employment. This means the contract must be in accordance with the Basic Conditions of Employment Act and it must be signed by both parties. To satisfy the criteria of the Act, the offer of employment must include the following information:
- Remuneration amount.
- Leave entitlement.
- Working hours.
- Termination period.
These mentions will help the Department of Labour determine whether an applicant will be fairly employed and treated once they take up the position they are applying for.
